But if the student loan is funded federally, and you want to get free from it, then you have to make the bankruptcy court know that the reimbursement of student loan will generate an "undue hardship" on you. If you are sure that you will become certified by going through the severe analysis of an "undue hardship" and get free from the student loan then you should go ahead.
There are three clauses which should be taken care of, in order to create "undue hardship".
They are:
On the basis of your current income and expenses, you cannot sustain a "minimal" standard of living for yourself and if you are required to reimburse the loans.
The added situations subsist representing that this position of dealings can possibly continue for a considerable period of reimbursement of the student loans.
You need to create good trust and attempt to reimburse your student loan. Court wills definitely in favor that you complete your payment of loans, and for that you need to have an ability to work hard. If you are living with your parents at home then court will not like to release student loan for you.
